ESTATE OF SELBOURNE COX, ALSO KNOWN AS SELBOURNE SYLVESTER COX, Deceased (833/A/05) AND ESTATE OF RACHEL COX, Deceased (926/P/05/B) — On the scheduled trial date of a contested proceeding by the administrator of the Estate of Selbourne Cox seeking to lift the SCPA 805(3) restrictions on her letters of administration in order to sell certain Bronx realty, the parties to that proceeding, who are also parties to another pending proceeding in the Estate of Rachel Cox involving the same realty (see Matter of Cox, 37 Misc 3d 1224 [A], 2012 NY Slip Op 52148 [U] [2012]; see also Matter of Cox, NYLJ, Jan. 6, 2012, at 23, col 2; Matter of Cox, NYLJ, Sept. 2, 2011, at 22, col 5; Matter of Cox, NYLJ, Mar. 25, 2011, at 30; 41), entered into a stipulation on the record in open court settling all issues in the pending proceedings in both estates.

Based on the parties’ stipulation, the court granted the application by the administrator of the estate of Selbourne Cox to lift the SCPA 805(3) restrictions on the letters of administration subject to the terms of the parties’ stipulation. Pursuant to the parties’ stipulation, the objections filed in the pending proceeding in the Estate of Rachel Cox were withdrawn, and that pending proceeding was marked “withdrawn” by the court on the record in open court.
