In their "Perspective" column of May 8, 2013, Jason L. Beckerman and Ryan T. Kearney argue that Labor Law §240, New York’s "scaffolding statute," (a) is harsher than that of any other state "in the nation," (b) has caused "[m]any private developers" "to take their projects across the Hudson River to New Jersey," and (c) has caused insurance premiums "to skyrocket."

The sole authority for the factual claims is two documents that appear on the website of an organization called Scaffold Law Reform. The authority for the legal claims regarding the laws of the 49 other states is the authors’ own assurances.
