I would like to clarify my comments about the New York State Law Revision Commission’s recommendations regarding spousal support in New York ("Commission Suggests Formula To Determine Maintenance," NYLJ, May 20).

While there are certainly issues which remain to be discussed, my feelings about the commission’s recommendations are overwhelmingly positive. I am heartened by the clear showing that the commission listened closely and thoughtfully to those of us who had great concerns about the interim and final maintenance legislation. That they suggested a reduced cap to which a presumptive (but deviateable) guideline on support would be applied, recommended the long overdue elimination of enhanced earnings distributions, and opted not to include any final support durational formula are worthy of emphatic commendation, and give hope for a continued dialogue which has equity and fairness as well as judicial discretion as a goal!
