ALBANY – Here's a tip from the New York State Court of Appeals to the folks at Starbucks: employees with a smattering of supervisory responsibilities can share in gratuities but full-fledged managers are out of luck.

In a split decision with three different writings, the court said in response to certified questions from the U.S. Court of Appeals for the Second Circuit that employees who routinely provide direct service to patrons are eligible to dip into the tip pool, even if they have limited supervisory responsibilities. But it drew the line at managers who exert "meaningful or significant authority or control over subordinates."
