ESTATE OF JOHN BRADY, Deceased (385A-2004/A) — In this proceeding to judicially settle the account of the Public Administrator, a kinship hearing was held before the court and referred on consent of all parties to a member of the court’s Law Department for continued hearing and to hear and report. More than 10 days have elapsed since the mailing of the referee’s report, and no party has moved to modify or overrule the report.
After review by the court, the findings of fact and conclusions of law set forth in the report are confirmed, including that (A) the decedent’s only paternal distributees are 13 paternal first cousins, namely: (1) Bridget Giblin; (2) Margaret Teresa Mohan; (3) Mary Ellen Clarke; (4) Kate Brady; (5) Rev. Edward Dunne; (6) Philip Michael Dowd; (7) Francis Joseph Dowd; (8) Anne C. McKeon; (9) Susan Porter; (10) Mary Catherine Smith; (11) Susan Elizabeth Anderson; (12) Mary Theresa McGuire; and, (13) Anna M. McDermott, each of whom, or their estate, is entitled to one-thirteenth of the paternal half of the estate or onetwenty- sixth of the net distributable estate; and (B) the decedent’s only maternal distributees are 20 maternal first cousins, namely: (1) Philip P. Connolly; (2) Patrick Connolly; (3) Rosemary Connolly; (4) Philip Mone; (5) Bridget Clare Dignam; (6) Rose McKenna; (7) Catherine Elizabeth Duffy; (8) Anna Elizabeth Mone; (9) James Mone; (10) John Mone; (11) Mary Josephine Molloy; (12) Margaret Ann Mone; (13) Margaret Jean Yocius; (14) Eileen Wagner; (15) John Philip Lennon; (16) Mary Ann Quinn; (17) Rose Margaret Fleming; (18) Kathleen Patricia Catherine Ena Foster; (19) Peter James Loughran; and, (20) Sheila Elizabeth Booth, each of whom, or their estate, is entitled to one-twentieth of the maternal half of the estate or one-fortieth of the net distributable estate (see EPTL 4-1.1 [a] [6]). The shares of the postdeceased distributees are to be paid to the duly appointed fiduciaries of their estates.
