Day laborers challenging a Long Island ordinance barring them from stopping or attempting to stop vehicles to solicit work can proceed with a free speech claim regardless of whether they can legally seek jobs, Eastern District Judge Denis Hurley (See Profile) has held.

Hurley also rejected a discovery demand by the Town of Oyster Bay to obtain the names of the individual complainants from the advocacy groups that brought an action on their behalf.
