ALBANY – A public defender who did not give an opening statement, conducted "cursory" cross-examination of prosecution witnesses, called no defense witnesses and offered an abbreviated summation failed to provide effective assistance of counsel, a unanimous upstate appeals panel has determined.
The Appellate Division, Third Department, reversed Tammy Bush's conviction in Chemung County Court on two counts of criminal possession of a forged instrument and ordered a new trial.
