ALBANY – New York's tough new gun laws have survived a constitutional challenge where an activist alleged that Governor Andrew Cuomo essentially precluded debate by sending the Legislature a sham "message of necessity" to permit an immediate vote.

The Appellate Division, Third Department, gave wide deference to the governor and said that "so long as some facts are stated" to justify an immediate vote, it will not interfere with a frequent Albany end-run around the constitutional requirement that bills "age" three days before they are voted on by the Legislature.
