Theodore Freedman, a former Kirkland & Ellis senior partner, was suspended Tuesday by the Appellate Division, First Department, as a result of pleading guilty to four counts of tax fraud earlier this year (NYLJ, March 6). The panel found that Freedman had committed a "serious crime" under Judiciary Law §90(4)(d), requiring an interim suspension.
An attorney who pleads guilty to a New York felony, or a felony in another jurisdiction with a New York equivalent, is disbarred automatically. Freedman pleaded guilty to a federal felony without an exact New York equivalent, meaning disbarment is possible but not automatic.
