A month after New York's Court of Appeals cleared the way for a long-lingering civil fraud trial involving former American International Group leaders Maurice "Hank" Greenberg and Howard Smith, the defendants are seeking to delay trial alleging that Manhattan Supreme Court Justice Charles Ramos (See Profile) is biased.

In a motion filed last week in Cuomo v. Greenberg, 401720/05, the defendants claim Greenberg and Smith cannot get a fair trial in Ramos' court, and especially not a fair bench trial. They complain that Ramos has been "aggressive and argumentative" toward the defense and has made remarks over the past several years suggesting he has prejudged the case.
