APPLICATION OF EDMOND DEMETRI OGEDENGBE, a Former Infant

MATTER OF THE APPLICATION OF EDMOND DEMETRI OGEDENGBE, a Former Infant (53/A/09) — In this contested proceeding by the former infant seeking to recover funds allegedly misappropriated by his brother, the former guardian of his property who is now pro se, the former infant moves to renew the branches of a prior motion seeking: (1) to strike the objections filed by the former guardian based upon his continued failure to provide discovery; and (2) an order granting summary judgment against the former guardian for the amounts for which he is liable over and above the sum already paid by the guardianship depository bank in settlement of the former infant's claims against it. The renewed motion is unopposed.

The branches of the renewed motion were denied without prejudice to renewal for noncompliance by decision and order dated April 11, 2013 which, inter alia, approved a stipulation between the former infant and the guardianship depository bank and directed the former guardian to comply with the parties’ outstanding discovery demands by June 3, 2013 (see Matter of Ogedengbe, NYLJ, Apr. 22, 2013, at 23, col 1).
