IN THE MATTER OF WILLIAM C. WETENDORF, as INCOME BENEFICIARY OF THE WILLIAM C. WETENDORF IRREVOCABLE TRUST CREATED BY WILLIAM C. WETENDORF, AS GRANTOR (675/13) — This is a proceeding commenced by the income beneficiary of an irrevocable inter vivos trust, who is also the grantor of the trust, seeking inter alia, to revoke the authority of the respondent trustees; the appointment of successor trustees; and a money judgment against the trustees and an additional respondent, John DiGiacomo. On the return date of the proceeding, the trustees filed opposition to the petition, Mr. DiGiacomo appeared pro se and the parties stipulated to a disclosure schedule in this matter which was "so ordered" by the court. Accordingly, this matter shall appear on the court's ready-for-trial calendar upon compliance by the parties in accord with the terms of the stipulation and the Uniform Rules for the Surrogate's Court (22 NYCRR) §§207.29 and 207.30.
