ESTATE OF ESMERALDO OLMO, Deceased (2013-614) — In this contested administration proceeding, the attorney for the cross petitioner moves, by order to show cause, for an order: (1) disqualifying and removing Oshrie Zak, Esq. as attorney for the petitioner, Robert Olmo, a son of the decedent; (2) directing Oshrie Zak and Michael Lippman Esqs. to cease any discussions with the petitioner regarding this case either directly or through intermediaries; and, (3) for an award of attorney’s fees. On the return date of the order to show cause Messrs. Zak and Lippman. and the petitioner appeared in opposition to the motion, and Mr. Zak submitted written opposition to the motion.

The decedent died on August 5, 2011 at the age of 74. His distributees are four children consisting of three sons, one of whom is under a disability due to his incarceration, and a daughter. The estate allegedly consists of approximately $250,000 in personal property and there is also realty located in Puerto Rico. Robert Olmo petitioned for letters of administration upon the waivers and consents of the daughter and the incarcerated son. Thereafter, another son, John Olmo, who is represented by Lorraine Coyle, Esq., the movant herein, cross-petitioned for letters of administration and, in the cross proceeding, Mr. Zak filed a notice of appearance for Robert and the two other allied children. The cross petitioner then moved for summary judgment; however, that motion was marked off the calendar after the filing and service of the instant disqualification application.
