A court officer's refusal to let a defense attorney's colleague into the courtroom during an undercover officer's testimony will result in a new trial for a defendant convicted of weapon possession and sale.
The Appellate Division, First Department, unanimously concluded on Tuesday that Eddie Moise's right to a public trial was violated when the court officer barred entrance to the attorney, who was one of the few people the trial judge had permitted to hear the undercover's testimony in the partially closed courtroom.
