ESTATE OF CYNTHIA L. Decedent Cynthia Wade died intestate at age 55 on November 16, 2010. Decedent’s administrator brought the action in New York County Supreme Court, which centered on alleged negligence in the operation of a motor vehicle that struck and killed decedent, who was a pedestrian.

The administrator, who is not a distributee of the decedent, waives statutory commissions. Reimbursement for the expense of decedent’s funeral, however, is sought by administrator. Net of claims, fees and disbursements, the administrator’s account, which she seeks to judicially settle, proposes distribution to decedent’s sole distributee, her father, who resides in a senior center in Massachusetts and for whom administrator serves as attorney-in-fact under a durable power of attorney. The guardian ad litem appointed by the court for the decedent’s father does not oppose the petition and does not object to the account.
