ESTATE OF FRANK MANDELBAUM, Deceased. (2181/07) — This is a proceeding to determine the meaning and validity of a provision of the will of Frank Mandelbaum. The petition, as amended, was filed by one of Mr. Mandelbaum’s two sons, Robert, as guardian of the property of his own son, Cooper John Mandell.

The issues in this proceeding include, but are not limited to, whether Cooper (along with any future child of Robert’s) is among the “grandchildren” and “descendants” of decedent given benefits in a trust established under Article SEVENTH of the will. Since Robert is a contingent beneficiary whose interests in the proceeding are technically adverse to Cooper’s, the court appointed a guardian ad litem to represent Cooper’s interests. The court appointed a different guardian ad litem to represent the competing interests of decedent’s other minor grandchildren.
