A Japanese medical equipment maker has been sanctioned by Southern District Judge Shira Scheindlin (See Profile) for deliberately destroying electronic records relevant to a lawsuit over an acquisition.
Scheindlin, who created the modern standard for preservation of electronic materials a decade ago in a series of decisions beginning with Zubulake v. UBS Warburg, 217 F.R.D. 309, ordered an adverse inference and monetary sanctions against Sekisui Medical Co. Ltd.
