The City of New York cannot be held liable for the death of a disabled 9-year-old boy at the private school in New Jersey where he was sent because his special needs could not be met in the city's schools, an appeals court ruled.

A unanimous panel of the Appellate Division, Second Department concluded that the city appropriately contracted for The Forum School of Waldwick, N.J., to meet the special educational needs of Jonathan Begley under state laws and the federal Individuals with Disabilities Education Act.
