The U.S. Court of Appeals for the Second Circuit is set for a full rehearing today on a controversial ruling allowing a former prisoner to bring a civil rights lawsuit after his initial conviction was overturned.
The case of Marcos Poventud has inspired sharp disagreement at the Second Circuit over the availability of civil rights recoveries for people who have served time in prison and are seeking both vindication and money damages. Following an April decision by a panel clearing the way for Poventud to sue, a majority of the active judges voted in June to rehear the case, setting up en banc arguments for 4 p.m. today.
