ESTATE OF JOSE FLORES-ANDINO, Deceased (2005/A/12) — This is a cross petition by the Public Administrator seeking the issuance of letters administration and an order dismissing the petition for letters administration originally filed by an alleged uncle of the decedent. On the return date of citation concerning the cross petition, there was no appearance in opposition either by the distributees or the uncle. A review of the file discloses the filing of an affidavit by counsel for the Public Administrator in which he represents that he spoke with the attorney retained by the uncle and that attorney confirmed to him that the uncle consents to the appointment of the Public Administrator.
