ESTATE OF EUGENE METZ, Deceased (183/A/10) — In this proceeding to judicially settle the account of the Public Administrator, the court previously determined the kinship issues with respect to the maternal half of the estate (Matter of Metz, NYLJ, Jan. 8, 2013, at 23, col 1). The kinship issues with respect to the paternal half of the estate were also referred to a member of the court’s Law Department designated to hear and report. More than 10 days have elapsed since the mailing of the referee’s report, and no party has moved to modify or overrule the report.

After review by the court, the findings of fact and conclusions of law set forth in report are confirmed, including that on the paternal side the decedent was survived by four paternal first cousins; namely, Louis Matis, Hilda Matis who post-deceased, Sanford Metz and Noach Matesevich. Each paternal distributee or their estate is entitled to 25 percent of the paternal half of the estate, or 12.5 percent of the entire net distributable estate (see EPTL 4-1.1 [a] [6]).
