ESTATE OF JOHN SHANNON Deceased, (3955/A/06) — This petition for leave to allocate the proceeds of the settlement of the causes of action for the conscious pain and suffering and wrongful death of John Shannon arising out of his exposure to asbestos, and to distribute the proposed net settlement proceeds, is granted.

The settled claims in question were brought against PLIBRICO COMPANY (now being administered through the PLIBRICO COMPANY TRUST), G-I HOLDINGS (now being administered through the G-I HOLDINGS TRUST), BURNS AND ROE ENTERPRISES INCORPORATED (now being administered through the BURNS AND ROE ENTERPRISES INCORPORATED TRUST), FIBREBOARD (now being administered through FIBREBOARD TRUST), U.S. MINERAL PRODUCTS COMPANY (now being administered through the U.S. MINERAL PRODUCTS TRUST COMPANY TRUST), KACC ASBESTOS PI (now being administered through KACC ASBESTOS PI TRUST), NATIONAL GYPSUM COMPANY (now being administered through NATIONAL GYPSUM COMPANY TRUST), AC & S (now being administered through the AC & S TRUST), CELOTEX CORPORATION, INGERSOLL-RAND COMPANY, PFIZER INCORPORATED, and ROBERT A. KEASBEY COMPANY in the Supreme Court, New York County. Attorney’s fees and disbursements were fixed by order of that court. The allocation of the settlement proceeds 90 percent to the cause of action for conscious pain and suffering and 10 percent to the cause of action for wrongful death as set forth in the petition is approved.
