ESTATE OF SADIE PERLMAN, Deceased. (0630/91) — In this uncontested proceeding, a co-trustee who is one of the presumptive remainder beneficiaries of a testamentary trust, petitions for an order authorizing an invasion of the trust principal, up to a maximum of $75,000, for the benefit of the sole income beneficiary.

The trust at issue was created under decedent’s Last Will and Testament dated June 24, 1984. Pursuant to the provisions establishing the trust, the income from the trust is distributable to decedent’s daughter, Anna Feld, during her lifetime. Upon Anna’s death, the principal is to be distributed to decedent’s four grandchildren (Anna’s four children). The will does not provide for invasion of principal for Anna’s benefit. The co-trustees of the trust are Anna’s daughter, petitioner herein, and Anna’s son, who has waived and consented to the requested relief. Anna’s two other children have also waived and consented.
