ESTATE OF PETER PIERUCCI, Deceased. (1938/08) — In the probate proceeding in the estate of Peter Pierucci, the court appointed a guardian ad litem for decedent’s brother, Andrew Pierucci, an adult under a disability, for the purpose of reporting on whether the April 13, 2012 amended probate decree should be modified to the extent it implicitly denied petitioner’s request for letters of trusteeship.

Decedent died at age 82, leaving a $200,000 estate. His will provides for the disposition of the residuary to Andrew Pierucci, provided, however, that, “if he be incapacitated or have Guardians at the time of my death, I give his bequest to my Trustee, to be held in separate trust for Andrew’s benefit.” Under the provision, trust income and principal are to be distributed to Andrew, at the discretion of the trustee, with distribution of income subject to a “support, maintenance and health and education” standard, and distribution of principal subject to a “support, maintenance and health” standard. Aris John Dousmanis, executor of decedent’s will, is also the nominated trustee.
