ALBANY – Part-time residents of a county or city in New York are eligible for gun permits, the state Court of Appeals ruled Tuesday.

Clarifying the state’s pistol and revolver license statute at the behest of the U.S. Court of Appeals for the Second Circuit, the state court determined that a primary residence is not necessary for a gun permit under New York law. While the court called the issue an “important question,” it did not address whether the licensing statute was constitutional, as plaintiff Alfred Oswerweil urged in Osterweil v. Bartlett, 167.
