IN THE MATTER OF THE APPLICATION OF RENEE RIMSKY TO INVALIDATE AN INTERVIVOS TRUST DATED MARCH 18, 2010, PURPORTEDLY CREATED BY VIVIEN SVIGALS, AS GRANTOR, AND FOR RELATED RELIEF. (4012/A/11) — At the call of the calendar in this proceeding for relief with respect to two inter vivos trusts created by the late Vivien Svigals, the court directed that the motion of respondent Susan Kirschenbaum to dismiss the crossclaim by respondent Carol Conard be held in abeyance. The basis for such direction is as follows.

This proceeding was commenced by Renee Rimsky, whom Ms. Svigals had named as her co-trustee under a revocable instrument dated December 7, 2006 (the “2006 Trust”), when Ms. Svigals was 85 years old. Under its provisions, the 2006 Trust was to continue for the balance of Ms. Svigals’ life, with principal distributable to her at her request; net of a pecuniary bequest to one individual, the remainder was left to the niece (Ms. Kirschenbaum) and nephew (Paul Svigals) of Ms. Svigals’ predeceased husband, in equal shares.1
