ESTATE OF RUTH SCHLESINGER, Deceased. (4234/A/05) — Jennie Schlesinger, legatee under the will of Ruth Schlesinger of a pre-residuary bequest of $100,000, less its proportionate share of estate taxes (see EPTL 2-1.8[c][1]), has petitioned to compel the accounting of Marcia Roiff as executor of decedent’s will.

Decedent died on September 26, 2005, leaving a $2.5 million estate, as valued on the probate petition. On October 1, 2007, petitioner executed a document whereby she acknowledged receipt of a sum “in full payment and satisfaction of the bequest,” released and discharged respondent “from all further liability or responsibility to her by reason of the bequest to her,” agreed to refund to respondent “any amounts necessary to pay any debt, taxes or other charges or expenses of any kind which, if charged to the executrix prior to distribution, would be a proper charge against the legacy receipted for,” and consented to the entry of a decree judicially settling respondent’s account and discharging respondent.
