ESTATE OF WILLIAM TURNER, Deceased, (2815/A/11) — This is a proceeding commenced by the decedent’s spouse, to compel an accounting by the executor, one of the decedent’s daughters. The decedent died testate on July 23, 2011 survived by a spouse and two daughters. His will dated February 28, 1977 was admitted to probate by decree dated January 25, 2012. The will bequeaths 35 percent of the residuary estate to the spouse, 25 percent of the residuary estate to each daughter, and 5 percent of the residuary each to a step-daughter, nephew and niece. The estate consists of personal property as well as real property.

The respondent filed objections to the petition wherein she requests that the proceeding be dismissed at this juncture, inter alia, because: 1) the three real properties that make up the bulk of the estate have not yet been sold but two of the properties are about to go to contract; 2) the petitioner is the only beneficiary of the estate who, to date, has received any distribution, consisting of a bank account and the cooperative apartment where she and the decedent resided; 3) the petitioner was provided with appraisals and the income and expenses for the real property; and, 4) there is no further information that could be disclosed to the petitioner at this time. As the respondent received letters testamentary on January 25, 2012, the court sees no basis why she cannot render an interim account at this time. Accordingly, the respondent’s objections and request that the petition be dismissed at this juncture are denied.
