ESTATE OF LEO MESSINA, ALSO KNOWN AS LEO J. MESSINA, Deceased (2746/A/11) — In this proceeding to judicially settle the account of the executor, the decedent's daughter, an SCPA 2211 examination of the executor was scheduled to occur on this date. Her counsel submitted an affirmation of actual engagement requesting an adjournment of the examination to occur on October 22, 2013 as he was required to appear on an Election Law matter on the date of the examination. The potential objectants recognize that Election Law matters take priority over the examination; however they requested that the court compel the executor to appear on the requested adjourn date to be examined. Under these circumstances, this decision constitutes the order of the court directing the executor to appear for her SCPA 2211 examination at 9:30 a.m. on October 22, 2013 in Room 328 of the Bronx County courthouse, and said examination is to continue each day thereafter until its completion. Objections to the account, if any are to be filed within 10 days of completion of the SCPA 2211 examination. Inasmuch as this matter was scheduled to appear on the court's calendar of October 22, 2013 as a control date contemplating that the executor's examination would be complete, the parties are advised that the control date of this matter is adjourned to the court's November 14, 2013 calendar date.
