PETITION FOR LEAVE TO SELL REAL PROPERTY IN THE MATTER OF ADRIAN ALBERTO MELENDEZ, AN INFANT. (3848/C/11) — Pending are two proceedings by Hannah Chocron, the mother and property guardian of Adrian Alberto Melendez, an infant, to sell the infant’s one-fifth interest in two pieces of real property. The guardian ad litem appointed to protect Adrian’s interest has advised that, while both proposed sales appear to be in his ward’s interest, neither property is currently titled to the property guardian on behalf of Adrian. A deed dated August 18, 2009, is in Adrian’s name (notwithstanding his minority) as owner of a one-fifth interest in property located at 90 First Street, Brentwood, New York. Title to a one-fifth interest in the second property, located at 75 East 3rd Street, Huntington Station, New York, was acquired by Adrian’s father, Daniel Melendez, as UTMA custodian for Adrian, by virtue of a Deed dated February 24, 2010.

The guardian ad litem advises that he has learned from family members that the properties were purchased with funds supplied by the infant’s father in the names of the father’s five children: the infant, his infant brother Ariel (the subject of two identical proceedings decided herewith), and their three adult half-siblings. The guardian ad litem advises that petitioner’s counsel has prepared Correction Deeds to retitle both properties to Hannah Chocron as Adrian’s guardian.
