New York state police do not have to release thousands of cartons of untaxed cigarettes that were seized at a checkpoint in northern New York, an Appellate Division, Third Department panel ruled last week.

The appeals judges overturned in Matter of HCI Distribution v. New York State Police, 516040, the June 2012 writ of prohibition issued by St. Lawrence County Supreme Court Justice David Demarest (See Profile) calling for immediate return of the seized cigarettes.
