ALBANY – A deal the Cuomo administration initiated “as part of a campaign to neutralize opposition to the legalization of non-Indian casinos” does not violate the U.S. Constitution, according to a Northern District federal judge.
Judge Lawrence Kahn (See Profile) on Wednesday rejected First Amendment and equal protection challenges to a pact made by Governor Andrew Cuomo and legislative leaders with the Oneida Indian Nation to ensure American Indians would not oppose a constitutional amendment that would permit the operation of Las Vegas-style casinos on non-Indian lands.
