ESTATE OF ELLEN MILCHIN, Deceased. (1480/11) — This is a contested probate proceeding in the estate of Ellen Milchin. Pending before the court is a motion to dismiss objections filed by decedent’s sister, Ann Studen, alleging lack of due execution, lack of capacity, undue influence and fraud.

Ellen Milchin died on August 20, 2010, at the age of 71, survived by Ms. Studen as her sole distributee. She left a will dated July 14, 1998, which has been offered for probate. The propounded instrument leaves her entire estate to her friend Elias Fouskas. In the event that Mr. Fouskas predeceased decedent, Ms. Milchin’s residuary estate was to be distributed to two other friends and her nephew (the objectant’s son) in equal shares. Mr. Fouskas and Donna Gilmore, another friend of decedent, are named as co-executors.
