A drug defendant convicted in absentia and sentenced to a stiff term under the Rockefeller Drug Laws has been denied resentencing by a judge who said the convict, while technically eligible for accommodation, is undeserving of leniency because he twice absconded from justice.

Queens Supreme Court Justice Robert Charles Kohm (See Profile) agreed with prosecutors that “substantial justice” dictates denial of Rafael Rosario’s motion for relief under the drug law reform measures enacted to ameliorate the harsh impact of the Rockefeller laws.
