With the long lingering West Valley nuclear cleanup project extended by at least several decades, a federal judge in Buffalo has dismissed New York State’s claim against the federal government on ripeness grounds.
Western District Judge John Curtin (See Profile) said that when the state brought the action in 2006, it had a reasonable basis to conclude that judicial resolution could be needed as soon as 2010, at that time the earliest possible date that nuclear waste south of Buffalo would begin reaching its final resting place in a federal repository.
