Re-licensing applications for the two nuclear power plants at Indian Point in Westchester County must include state-approved coastal management plans, a state judge ruled.

Entergy Nuclear Operations, owners of the Indian Point 2 and 3 units, had argued that the plants were exempt from the environmental review required by the program. But the Department of State disagreed and Albany Supreme Court Justice Michael Lynch (See Profile) upheld the state agency’s decision, finding it was a “rational” interpretation by the Department of State of the requirements of the Federal Coastal Zone Management Act.
