(13/152) — In this contested administration proceeding, Marilyn Weinstein died intestate on October 20, 2012, survived by her husband, Israel Leon Weinstein, and two children, Susan Weinstein, a daughter, and Edward Weinstein, a son. Edward Weinstein is under a disability and has a Guardian ad Litem appointed to protect his legal interests.

A petition for Letters of Administration was filed by Israel Leon Weinstein on February 13, 2013 and a cross-petition was filed by Susan Weinstein on March 8, 2013. Cross-petitioner subsequently filed a motion seeking, inter alia, that the petition by Israel Leon Weinstein be summarily denied, that her crosspetition be granted, and that Israel Leon Weinstein, as surviving spouse of the decedent be disqualified, pursuant to EPTL 5-1.2(a)(5), due to his abandonment of the decedent.
