(85/5845) — This is an uncontested application filed by Lofton Holder (“petitioner”), co-trustee of two trusts created under the will of Roslyn Rubin (“testator”), seeking to have the trusts converted into unitrusts pursuant to EPTL §11-2.4.

Testator died in 1985. Pursuant to the terms of her will, testator’s residuary estate was divided into two trusts, one for the benefit of her daughter, Barbara Rubin, and the other for the benefit of her other daughter, Patricia Rubin Yenawine. Barbara and Patricia are each entitled to the income from their respective trusts during their lives. Upon each of their deaths, the principal from their respective trusts is to be distributed equally among testator’s grandchildren.
