EMILY PINES res, v. STATE OF NEW YORK, ap — (INDEX NO. 13518/10) APPEAL by the defendant, in an action for a judgment declaring that the compensation of judges and justices of the Unified Court System of the State of New York was duly increased pursuant to the Laws of 2009, chapter 51, §3, and that the defendant is obligated to pay the judges and justices of the Unified Court System of the State of New York in accordance therewith retroactive to April 1, 2009, from a judgment of the Supreme Court (Karen V. Murphy, J.), entered in Nassau County on March 16, 2011, which, upon an order of the same court dated February 9, 2011, granting the plaintiffs’ cross motion for summary judgment declaring that the compensation of judges and justices of the Unified Court System of the State of New York was duly increased pursuant to the Laws of 2009, chapter 51, §3, and that the defendant is obligated to pay the judges and justices of the Unified Court System of the State of New York in accordance therewith retroactive to April 1, 2009, and, in effect, denying the defendant’s converted motion for summary judgment, in effect, declaring, inter alia, that the compensation of judges and justices of the Unified Court System of the State of New York was not duly increased by the enactment of the Laws of 2009, chapter 51, is in favor of the plaintiffs and against it, declaring that the compensation of judges and justices of the Unified Court System of the State of New York was duly increased by the enactment of the Laws of 2009, chapter 51, §3, and directing the defendant to pay the judges and justices of the Unified Court System of the State of New York in accordance therewith retroactive to April 1, 2009.
