A man’s decision to jump off a pier into the Long Island Sound on a dare may have been stupid, but it was not trespassing, a Rye city court judge determined.
Judge Joseph Latwin (See Profile) said that the Long Island Sound off Rye is a public body of water owned by the State of New York. And since defendant Sonny Om is a member of the public, he “had a right” to enter the sound and cannot be charged with trespass for jumping in, the judge ruled in People v. Om, 2013 NY Slip Op 52285(U).
