A Bangladeshi businessman who claimed Bangladesh police tortured him at the direction of a former business partner cannot sue in federal court under the Alien Tort Statute, the U.S. Court of Appeals for the Second Circuit held Monday.
The circuit said a 2013 U.S. Supreme Court decision holding the Alien Tort Statute cannot apply to violations of customary international law committed outside of the United States meant that Nayeem Mehtab Chowdhury may not recover damages under the act for torture inflicted in Bangladesh.
