The state Court of Appeals has declined, for a second time, to hear an appeal of the denial of a habeas petition filed by Gigi Jordan, the multimillionaire facing a charge of murdering her 8-year-old son. Without comment, the judges said on Feb. 18 they will not hear Jordan’s appeal in People & c. ex rel. Ronald L. Kuby, on behalf of Gigi Jordan v. Agro, 2013-1290.
Jordan maintained in the habeas action that her pretrial detention at Rikers Island, now in its 46th month, violates her right to due process. She sought unsuccessfully for Court of Appeals’ intervention after the an Appellate Division, First Department, denied her petition on Nov. 19, saying the decision to keep her jailed as a flight risk was within the discretion of Supreme Court Justice Charles Solomon.
