ESTATE OF ANNA CORN, Deceased (97/3016/B) — At the call of the calendar in this contested accounting proceeding in the estate of Anna Corn, the court directed objectant Leslie Fradkin (pro se) to respond to all document discovery demands and appear for deposition by February 28, 2014. The court further stated that, if Mr. Fradkin failed to satisfy such discovery obligations by that date, the court would grant the executors' motion to strike his objections pursuant to CPLR §3126.

The executors’ motion papers demonstrated that Mr. Fradkin failed to comply with outstanding discovery demands for an extended period of time without a legitimate excuse. Mr. Fradkin’s opposition papers were replete with contradictory and unsupported statements that did not adequately excuse his failure to provide the requested discovery in a timely manner or supply a justification for the additional adjournment that he requests.
