ESTATE OF NELLIE ORWASHER, Deceased. (13/3064) — Before the court are competing applications for preliminary letters testamentary in the Estate of Nellie Orwasher.

Nellie Orwasher died on February 5, 2013, survived by her husband, Louis Orwasher, and three sons. In her will, dated March 9, 1999, she left part of her estate outright to Louis, and part in trust for him, with the remainder, if any, subject to a limited power of appointment granted to Louis, or, if it were unexercised, equally to two of her sons, Abram and Stanley Orwasher. She nominated the following as executor or executors: in the first instance, Louis; in the second and third instances her accountants Jesse Weiss and Gordon Weiss singly, in the order named; and, finally, if both of them failed to serve, Stanley and Abram to serve jointly. She nominated Jesse Weiss to serve alone as trustee, followed by Gordon Weiss, then followed by a successor to be designated by the later of them to serve.
