New York State violated the constitutional ban on decreasing judicial salaries by reducing the state’s contribution to judges’ health insurance premiums, a unanimous panel of the Appellate Division, First Department, held on Tuesday.
The court said the reduced contribution “increased the amounts withheld from judicial salaries [and] constitutes an unconstitutional diminution of judicial compensation.”
