ESTATE OF ABRAHAM FRYDMAN, Deceased. (10/2912) — In this contested probate proceeding, Erika Frydman ("Erika"), the proponent for the probate of two identical original instruments dated July 7, 2008 (the July 7, 2008 instrument[s]")1 in the estate of Abraham Frydman, moves for an order granting summary judgment, dismissing the objections filed by David Frydman ("David"), one of the decedent's sons. The motion is opposed by David. For the reasons stated below, the motion is granted. To the extent Erika, in her reply papers, is seeking sanctions against David for frivolous litigation, that request is denied.

A guardian ad litem was appointed to represent the interests of Benjamin Frydman, the decedent’s infant son. He has filed an affidavit in support of Erika’s motion for summary judgment.
