ESTATE OF ELLA SEASE, a/k/a ALI WARDAH, a/k/a WARDAH ALI Deceased. (08/4978/A) — This is a proceeding for judicial settlement of an accounting by the Kings County Public Administrator (the petitioner), as administrator of the estate of Ella Sease, a/k/a Ali Wardah, a/k/a Wardah Ali (the decedent), who died intestate on July 24, 2008. The petitioner was issued Letters of Administration on March 20, 2009, and commenced the instant proceeding on November 17, 2010. Upon filing the petition and account, the petitioner cited i) the executor of the estate of an alleged distributee, Ruth Gumb (the Gumb estate), ii) Allan Dobson (Dobson) based on his claim for reimbursement of sums alleged to have been spent for support of the decedent (the claim for reimbursement), iii) Mytheria Ann Jessup (Jessup) and Ora M. James (James, and together with Dobson and Jessup, the objectants) based on their claim of equitable adoption by the decedent, iv) two alleged creditors of the decedent’s estate, Asset Acceptance, LLC (Asset Acceptance), and HSBC Bank Nevada, N.A. (HSBC), v) the New York State Department of Taxation and Finance, vi) the Attorney General of the State of New York, and vii) The New York City Human Resources Administration. In addition, the petitioner duly published for all unknown distributees of the decedent’s estate, pursuant to SCPA §307(3)(a). A guardian ad litem was appointed to represent the interests of unknown distributees of the decedent’s estate.
Verified objections to the instant petition were filed on March 11, 2011, by the objectants, in which they asserted their claim as the decedent’s sole distributees on the grounds of equitable adoption, and in which Dobson further asserted his separate claim for reimbursement. No appearance was entered, nor objections filed, by or on behalf of the Gumb estate, however, a notice of appearance was filed on behalf of seven purported maternal distributees (the purported maternal kin). No appearance was entered, nor objections filed, by or on behalf of either of Asset Acceptance or HSBC, whose claims had been presented and rejected for lack of substantiation.
