I read of the support expressed by the New York City Bar Association for the use of a virtual law office street address for an attorney’s principal law office address, as contemplated in the New York Rules of Professional Conduct (NYLJ, June 9) and wish to suggest an amendment. I recently had need for the trial testimony of an attorney in connection with work he had performed in a previous case involving my client. The attorney could not be served with the subpoena at his virtual office address. I was only eventually able to reach the attorney with the assistance of the Office of Court Administration.
In permitting attorneys to use virtual law office addresses, some consideration should be given to requiring the appointment of an agent for service of process, perhaps the OCA, just as the appointment of the secretary of state as agent for service of process upon a corporation is required upon the corporation’s formation.
