MATTER OF JONSHER REALTY CORP./MELBA, INC., res, v. BOARD OF ASSESSORS ap — (INDEX NO. 595/12)In a proceeding pursuant to CPLR article 78, in effect, in the nature of mandamus to compel the calculation of transition assessments for two parcels of real property for tax year 2007/2008 and thereupon to compel the refund of overpayments of taxes, the appeal is from a judgment of the Supreme Court, Nassau County (Adams, J.), dated June 13, 2012, which granted the petition and directed the calculation of the transition assessments and the issuance of an appropriate refund.
