A divided Court of Appeals on Tuesday struck down an Albany County anti-cyberbullying law, finding its broad language violates the First Amendment.
The 5-2 ruling in People v. Marquan M., No. 139, held that while criminal laws against cyberbullying among minors are not necessarily illegal, Albany’s law as written went too far and criminalized protected speech.
